JP Elektroprivreda BiH from European Court asked for protection on ownership rights over property in Croatia
JP Elektroprivreda BiH d.d. – Sarajevo has lodged six applications related to protection on ownership rights in the territory of Croatia , to European Court of Human Rights in Strasbourg , on November 29, 2013 . The applications are considered to the properties (buildings and land) which JP Elektroprivreda BiH has in possession in places in Croatia Sutivan , Gradac , Makarska , Biograd na Moru , Lukoran and Baške Vode .
The Legal team of Elektroprivreda BiH- Sarajevo, has investigated all jurisdical basis with aim to protect their property and referent rights within jurisdical system of the Republic of Croatia .
The key obstruction for postive solution on the application of Elektroprivreda BiH - Sarajevo was Regulation on Prohibition on disposal of real estates in the territory of Croatia and Law on Prohibition of disposing and taking over of assets of certain Legal Entitty in the territory of the Republic of Croatia .
With enacting of Regulation on Prohibition on real estates disposal in territory of Croatia have been created complicated mechanisms which do not enable efficient protection of property of Legal Entity from the republics of ex-Yugoslavia .
In the submmited documents to the European Court of Human Rights in Strasbourg , JP Elektroprivreda BiH has pointed out that in relations of administrative and juridical bodies of Republic Croatia against Elektroprivreda's ownership rights have been violated the provisions of European Convention refering to protection of human rights and fundamental freedom, rights to legally possesion, rights to legally and publicly trial and rights to effective legal remedy .
JP Elektroprivreda BiH- Sarajevo expects from the European Court of Human Rights in Strasbourg to be in position to commit the Republic of Croatia to harmonize its legal provisions with European Convention and enable accession to competitive agencies in Croatia with aim to be protected rights on property , rights to returning of deprived property , realising of ownership rights , and adequate compensation for non- material damages was requested.
